This platform is intended exclusively for licensed healthcare professionals. It does not constitute medical advice and is not intended for patient use.

1. Agreement to These Terms

By accessing or using https://www.sendrx.to(the “Platform”), you (“User”) agree to be bound by these Terms of Use (“Terms”). If you do not agree, you must immediately discontinue use of the Platform. These Terms constitute a binding legal agreement between you and SendRx.to.

2. Professional Use Only — Eligibility

The Platform is designed and intended exclusively for use by licensed healthcare professionals — including but not limited to physicians, physician assistants, nurse practitioners, pharmacists, and their authorized staff — acting within the scope of their professional licensure and applicable law.

By using the Platform, you represent and warrant that:

  • You are a licensed healthcare professional or an authorized representative of a licensed healthcare practice;
  • You have the authority to bind yourself and your organization to these Terms;
  • Your use of the Platform is solely in your professional capacity; and
  • You will not allow patients, consumers, or other unlicensed individuals to access the Platform through your account or credentials.

If you do not meet these eligibility requirements, you are not permitted to use this Platform.

3. Not Medical Advice — No Clinical Guidance

Important Disclaimer

Nothing on this Platform constitutes medical advice, clinical guidance, or a recommendation regarding the diagnosis, treatment, prescribing, or management of any patient or medical condition.

The Platform provides pharmacy routing and formulary reference information only — including specialty pharmacy options, prior authorization requirements, insurance plan routing, drug savings programs, and acquisition logistics (including buy-and-bill and medical benefit information). This information is intended to assist licensed prescribers in navigating the administrative and logistical aspects of specialty medication access.

All clinical decisions — including decisions about whether to prescribe a medication, the appropriate dosage, duration of therapy, monitoring, contraindications, and patient suitability — remain entirely within the professional judgment and responsibility of the treating clinician.SendRx.to expressly disclaims any responsibility for clinical decisions made by users of the Platform.

4. Not a Pharmacy, PBM, or Insurance Plan

SendRx.to is not a pharmacy, pharmacy benefit manager (PBM), specialty pharmacy, distributor, insurance company, or health plan. The Platform does not:

  • Dispense, sell, transfer, or fulfill prescriptions or medications;
  • Process insurance claims or prior authorizations;
  • Negotiate or guarantee drug pricing, reimbursement, or formulary placement;
  • Verify current formulary status, tier placement, or coverage eligibility for any specific patient or plan;
  • Guarantee availability of any savings program or patient assistance benefit; or
  • Act as an intermediary between prescribers and pharmacies for the purpose of dispensing.

References to specific pharmacies, distributors, savings programs, or insurance plans on the Platform are provided for informational and routing reference purposes only. They do not constitute endorsements, partnerships, or guarantees of service, availability, or coverage.

5. Accuracy, Currency, and Completeness of Information

Formulary structures, prior authorization requirements, specialty pharmacy networks, insurance plan routing, drug savings program eligibility, buy-and-bill acquisition procedures, J-codes, and related information change frequently and without notice. While SendRx.to makes reasonable efforts to maintain accurate and current information, we make no representation, warranty, or guarantee — express or implied — that any information on the Platform is:

  • Accurate, complete, or current as of the date of your access;
  • Applicable to any specific patient, insurance plan, or payer contract;
  • Applicable in your state or jurisdiction; or
  • Free of errors, omissions, or outdated data.

You are solely responsible for independently verifying all information — including formulary status, PA requirements, pharmacy network participation, savings program eligibility, payer policies, and acquisition procedures — directly with the relevant pharmacy, payer, manufacturer, or distributor before making any prescribing, routing, or acquisition decision.

Pharmacy data is sourced in part from the CMS National Plan and Provider Enumeration System (NPPES) NPI Registry. SendRx.to does not guarantee the accuracy or completeness of NPI Registry data.

6. Patient Privacy — Do Not Enter Patient Health Information

The Platform is a reference and routing tool. You should not enter, upload, transmit, or otherwise input any patient-identifiable information — including names, dates of birth, insurance member IDs, diagnoses, or any other Protected Health Information (PHI) as defined under HIPAA — into the Platform.

SendRx.to is not configured or intended to serve as a HIPAA-covered entity or business associate in connection with the transmission or storage of PHI. Any PHI you input into the Platform is entered at your sole risk. SendRx.to assumes no liability for any breach, disclosure, or unauthorized access to PHI transmitted through or stored on the Platform.

You are responsible for ensuring your use of the Platform complies with all applicable federal and state privacy laws, including HIPAA, HITECH, and applicable state medical records laws.

7. Buy-and-Bill and Medical Benefit Information

Some information on the Platform relates to medications administered in-office under the medical benefit (buy-and-bill), including distributor contacts, J-codes, and payer policy notes. This information is provided as a general reference only.

Payer policies regarding buy-and-bill versus white-bagging vary and change frequently. You are solely responsible for verifying the applicable acquisition and billing requirements with each individual payer before ordering or administering any medication. SendRx.to makes no representation regarding coverage, reimbursement, or prior authorization outcomes for any specific patient or payer.

8. Third-Party Links and Resources

The Platform may contain links to third-party websites, including specialty pharmacy patient portals, drug manufacturer savings program enrollment pages, distributor contacts, and insurance plan resources. These links are provided for convenience only.

SendRx.to has no control over, and assumes no responsibility for, the content, privacy practices, accuracy, or availability of any third-party website or resource. Inclusion of a link does not imply endorsement, partnership, or any commercial relationship with the linked entity.

9. Intellectual Property

All content on the Platform — including drug routing data, savings program summaries, user interface elements, text, and design — is the proprietary information of SendRx.to or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for your internal professional reference purposes. You may not reproduce, distribute, scrape, resell, sublicense, or create derivative works from any content on the Platform without express prior written consent from SendRx.to.

10. Disclaimer of Warranties

THE PLATFORM AND ALL INFORMATION PROVIDED THEREIN ARE OFFERED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SENDRX.TO EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE;
  • WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS;
  • WARRANTIES AS TO THE ACCURACY, CURRENCY, OR COMPLETENESS OF ANY INFORMATION ON THE PLATFORM; AND
  • WARRANTIES THAT RELIANCE ON THE PLATFORM WILL RESULT IN COVERAGE APPROVAL, PRESCRIPTION FILL, OR REIMBURSEMENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SENDRX.TO, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
  • LOSS OF REVENUE, PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY;
  • PATIENT HARM, ADVERSE OUTCOMES, MISSED DIAGNOSES, OR CLINICAL ERRORS;
  • DENIED INSURANCE CLAIMS, PRIOR AUTHORIZATION FAILURES, OR REIMBURSEMENT DISPUTES;
  • PHARMACY ROUTING ERRORS OR FAILURE TO ACCESS SAVINGS PROGRAMS;

arising out of or related to your use of — or inability to use — the Platform, even ifSendRx.to has been advised of the possibility of such damages.

IN NO EVENT WILL SENDRX.TO'S AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SENDRX.TO IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

12. Indemnification

You agree to indemnify, defend, and hold harmless SendRx.to, its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of or reliance on the Platform;
  • Any clinical, prescribing, or treatment decision you make in connection with information obtained from the Platform;
  • Your violation of these Terms or any applicable law or professional obligation;
  • Any breach of your representations and warranties herein; or
  • The unauthorized use of the Platform by any third party through your account or credentials.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered under the rules of the American Arbitration Association (AAA) in a mutually agreed location, and the arbitrator's decision shall be final and binding. You waive any right to a jury trial or to participate in a class action.

14. Changes to These Terms

SendRx.to reserves the right to modify these Terms at any time. The effective date at the top of this page will be updated to reflect changes. Your continued use of the Platform after any modification constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Platform.

15. Regulatory Status

The Platform is an informational reference tool and is not a medical device as defined by the U.S. Food and Drug Administration. It is not intended to diagnose, cure, treat, or prevent any disease, nor does it support clinical decision-making for the purpose of FDA medical device classification. Nothing on the Platform has been reviewed or approved by the FDA, CMS, or any other regulatory body.

16. Entire Agreement / Severability

These Terms constitute the entire agreement between you and SendRx.to with respect to the Platform and supersede all prior agreements, understandings, and representations. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
